End-User License Agreement

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes in connection with hydrovac and related field services.

2. Accounts and Access

Access is provided to authorized administrators, drivers, and client companies. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Acceptable Use

• Do not use the Service for any unlawful or unauthorized purpose.
• Do not attempt to gain unauthorized access to accounts, systems, or data.
• Do not interfere with or disrupt the integrity or performance of the Service.
• Do not reverse engineer, copy, or resell the Service except as permitted by law.

4. Third-Party Services

The Service integrates with third-party providers, including Intuit QuickBooks Online (read-only accounting data), mapping providers, fleet telematics, and SMS delivery. Your use of those integrations may also be subject to the providers' own terms. We access QuickBooks data only as you authorize and on a read-only basis.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and use information. By using the Service, you consent to those practices.

6. Intellectual Property

The Service, including its software, design, and content, is owned by Xtreme Hydrovac or its licensors and is protected by applicable laws. This Agreement does not grant you any ownership rights in the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, Xtreme Hydrovac will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Service.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate this Agreement or if we discontinue the Service. Upon termination, the license granted to you ends immediately.

10. Governing Law

This Agreement is governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-law principles.

11. Changes to This Agreement

We may update this Agreement from time to time. We will post the revised version on this page and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
